Clean Energy Works Oregon – Application Terms and Conditions
Program Details: Clean Energy Works is an energy efficiency remodel financing program. Details of the Clean Energy Works Oregon program are subject to change without prior notice. Funds are subject to availability and are provided on a first come, first served basis.
- Participants own and live in the home to be retrofitted through Clean Energy Works Oregon
- Participating homes are single-family, site-built dwellings (no mobile homes, manufactured homes, townhomes or floating homes)
- Participating homes are located within a Clean Energy Works Oregon Service Area
- Participating homes in Clackamas, Multnomah and Washington Counties must currently (or upon completing Clean Energy Works Oregon) be heated with electricity or natural gas from NW Natural, Pacific Power or Portland General Electric
- Participating homes were built before 1993
- Participating homeowners are not participating in another Oregon weatherization program
Participant:The person accepting these terms and conditions is the Participant and certifies that he/she is eligible for the program and has full authority to execute the application and accept the terms and conditions on behalf of all applicants. These terms and conditions shall apply to all applicants.
Instant Rebate Eligibility: Instant Rebates are available on a first come, first served basis, subject to change without prior notice, non-transferable and will only be reserved for a qualified applicant for a limited time.
Authority to Collect Utility Usage and Payment History and Credit and/or FICO score: Participant understands, acknowledges and agrees that Clean Energy Works Oregon and/or its representatives may access Participant’s primary heat source utility usage data and payment history, conduct credit check and obtain Participant’s credit and/or FICO score in order to evaluate whether Participant qualifies for the Clean Energy Works Oregon program and loan. Participant acknowledges that adding any additional applicants results in a joint credit application and that Participant has proper acknowledgment and authority to execute the application on behalf of all parties.
Clean Energy Works Oregon Instant Rebates: By participating in the program, Participant understands, acknowledges and accepts that any available Clean Energy Works Oregon Instant Rebates will be applied first toward applicable program fees and second reduction in the principal amount of any loan to Participant under the program. Instant Rebates are available on a first come first served basis while supplies last. In no event shall the Clean Energy Works Oregon Instant Rebates exceed twenty-five (25%) of the cost to Participant of the energy efficiency measures installed. Participant agrees that by accepting Clean Energy Works Oregon Instant Rebates they are forfeiting Energy Trust of Oregon Instant Rebates for measures installed as part of Clean Energy Works Oregon program participation.
Access and Evaluation: Clean Energy Works Oregon and/or its representatives may request access to the property and may review and evaluate the project during and after the Comprehensive Home Performance Assessment and completion of any energy efficiency installations. Participant agrees to provide reasonable access to the property for the purposes described herein.
Utility Usage and Payment Information: Participant agrees that Clean Energy Works Oregon and/or its representatives may access Participant’s electric and/or gas utility usage data and payment history for a period of twelve months before and after completion of the energy efficiency upgrade.
Property Rights: Participant represents that Participant has the right to complete and/or install the energy efficiency measures on the property on which those measures are completed and/or installed and that any necessary consents have been obtained.
Verification and Inspection: Prior to any authorization to provide Clean Energy Works Oregon funds or to disburse loan funds to a Participant’s contractor, Clean Energy Works Oregon’s Energy Advisor will verify that the installed energy efficiency measures meet the completed Home Performance Reporting Software requirements to include a Certificate of Completion. No warranty of any kind is implied by this verification process.
Project Information Release: As used herein, “Project Information” may include the name, address, ethnicity, gender, household size, energy efficiency measures installed and resulting energy-savings, cost of project, loan information (including name of lending institution, term, interest rate, payment schedule), FICO score, utility payment and usage data, household income, debt to income calculation, property value, prior existing outstanding debt, and fact of any bankruptcy or foreclosure within previous seven years. Participant agrees that Clean Energy Works Oregon may include Participant’s Project Information in reports or other documentation submitted to the Clean Energy Works Oregon Board of Directors, the City of Portland, the United States Department of Energy, participating local governments, the Energy Trust Board of Directors, the Oregon Public Utility Commission, Oregon Department of Energy and/or the Oregon Legislature. Clean Energy Works Oregon and its service partners will treat personally identifiable information, including social security number and date of birth, as confidential.
Disclaimer/No Liability: Participant understands that, while Clean Energy Works Oregon provides funding for Comprehensive Home Performance Assessments and funding to reduce principal loan amounts for the energy savings measures that Participant may choose to install after the Comprehensive Home Performance Assessment, Clean Energy Works Oregon is not performing the Comprehensive Home Performance Assessment, the installation of CFLs, a high performance showerhead, faucet aerators and water heater temperature turn-downs, nor is Clean Energy Works Oregon responsible in any way for proper completion of that work or for proper performance of the equipment installed in a Participant’s home. Clean Energy Works Oregon does not guarantee energy savings results.
Oregon Department of Energy: Participant understands, acknowledges and agrees that the Oregon Department of Energy may contact Participant about its participation in the Clean Energy Works Oregon program.
Tax Liability: Clean Energy Works Oregon is not responsible for any tax liability, which may be imposed on the Participant as a result of participation in the program or any loan or financing obtained through the program. Clean Energy Works Oregon is not providing tax advice, and any communication by Clean Energy Works Oregon is not intended or written to be used, and cannot be used, for the purpose of avoiding penalties under the Internal Revenue Code.
No Endorsement: Clean Energy Works Oregon does not endorse any particular manufacturer or product, in promoting the program. The fact that the names of particular manufacturers, products or systems may appear on a particular program bid or other related documentation does not constitute an endorsement. Manufacturers, products, or systems not mentioned are not implied to be unsuitable or defective in any way.
Loan Assignment and Contractor Payment: Participant agrees to use borrowed funds for the purpose of installing energy efficiency upgrades to the home identified in the application. All funds will be disbursed directly to the contractor who is installing the upgrades, pursuant to a contract directly between Participant and contractor. Payment will be disbursed upon completion of the upgrades and certification by Clean Energy Works Oregon’s Energy Advisor that the installed energy efficiency measures meet program requirements. Participant understands that the Clean Energy Works Oregon program lender will provide the total proceeds of the loan and the applicable incentives directly to the contractor in the form of payment for work completed and verified. Clean Energy Works Oregon and lender are not responsible in any way for proper completion of that work or for proper performance of the equipment installed in a Participant’s home.
Photo release: Participant authorizes Clean Energy Works Oregon or its agents to take photographs of Participant and Participant’s family, home and the energy efficiency upgrades and gives permission to Clean Energy Works Oregon to use and publish the collected photographs and information concerning Participant’s project.
Media Contact: Participant is willing to be contacted by members of the media about Participant’s Clean Energy Works Oregon project.
